The 106th United States Congress adjourned before
any additional action was taken on HR 4424 and
HR 4244...bill introduced in 2000 that related
to using criminal history records for screening
volunteers. To date, the 107th Congress has not
introduced related legislation.
However, efforts are underway to get additional
states to join the National Crime Prevention and
Privacy Compact. The compact asks states to share
criminal record information with other jurisdictions
in response to noncriminal justice requests including
background checks.
Only six states - Florida, Georgia, Nevada, Montana,
Colorado, and Iowa - have ratified the Compact
since it was enacted in 1998.
The FBI has established the Interstate Identification
Index. Then an inquiry is made it searches simultaneously
the databases of each state's criminal history
record repository. In order for the system to
work effectively, however, each state needs to
participate in the Compact.
