note, permission is given for one-time
use only. The American Camping Association,
Inc. is the owner of several forms of
media communication, including the media
identified as the American Camp Association
Photographs ("Photos"). While
ACA-Accredited® camps,
business affiliates, business partners,
individual members, and authorized media
organizations in good standing may use
the Photos in accordance with the following
terms and conditions, such use shall
always be at the ACA's Discretion. Use
of one or more of the Photos shall constitute
consideration for, agreement to, and
acceptance of the following terms and
conditions of this license by the user:
Only ACA Members And Authorized Media Organizations May Use ACA Photos
- The Photos are the sole and exclusive intellectual property of ACA. The Photos may be used only by ACA members and Authorized Media Organizations in good standing if and only if such use is made pursuant to the terms and conditions of this limited and revocable license. Any failure by a user to comply with the terms and conditions contained herein may result in the immediate revocation of this license, in addition to any other sanctions imposed by ACA.
ACA Media Must Not Be Physically Altered
- The Photos may not be revised or altered in any way, and must be displayed in the same form as produced by ACA.
ACA Photos Can Only Be Used In Media Products Regarding ACA
- Photos may only be used to promote the camp experience
in articles, videos, or other media
in which the American Camp Association
is described and referred to within the contents of the given
medium of media communication. ACA photographs are not to be used
as stock photography. Use of photographs for publications relating,
but not limited to sexuality and relevant social issues is strictly
prohibited.
ACA Photos Are ACA Property
- Use of the Photos shall create no rights for users in or to the Photos or their use beyond the terms and conditions of this limited and revocable license. ACA reserves the right to request samples of use of the final product in which the Photos are used in order to determine compliance with these terms and conditions. Without further notice, ACA reserves the right to prohibit use of the Photos if it determines that a user's Photo usage, whether willful or negligent, is not in strict accordance with the terms and conditions of this license, otherwise could discredit ACA or tarnish its reputation and goodwill, or the user is not an ACA-Accredited® camp, business affiliate, business partner, individual member, or authorized media organization in good standing. The ACA may revoke this license for any reason it sees fit upon written notification to you. Furthermore, User must accompany any reproduction of a picture with a credit line or copyright notice, in the form "© American Camping Association, Inc."
If A Federal Law Is Broken, It Will Be Settled In Indiana
- Use of ACA Photos indicates your consent to the interpretation of this agreement by Indiana law, as well as your consent to jurisdiction and venue in the courts located in Marion County, Indiana. All actions regarding the Photos shall be brought and maintained in the courts located in Marion County, Indiana, and you hereby waive all objections to jurisdiction and venue therein.
If you would like to use any variations
of the Images or if you would like to use
any of the Images for any purpose not authorized
by these terms and conditions, you must
seek our express written permission (which
we may withhold at our absolute discretion).
